Boroondara Arts - Conditions of Sale for TicketsBefore proceeding with your purchase, please read these Terms and Conditions carefully. You must not complete your purchase unless you agree with these Terms and Conditions. In these Terms and Conditions: Council means the City of Boroondara and includes the City of Boroondara’s employees, agents and contractors; Event Organiser means the person, group or body responsible for presenting a performance, event, or activity at the Venue; Terms and Conditions means these terms and conditions, as amended from time to time; Venue means the premises and/or venue to which your ticket relates, which may include but is not limited to, the Hawthorn Arts Centre, Town Hall Gallery, Kew Court House, and any other venue, premises or space owned, operated or made available for use by Council; and You or Your means you and includes any children or dependents under your supervision. 1. Terms and Conditions By purchasing a ticket, you agree to comply with these Terms and Conditions. 2. Application (a) the purchase of tickets for performances and events at Council’s Venues including but not limited to Hawthorn Arts Centre, Kew Court House, and Town Hall Gallery; and (b) the purchase of tickets for performances and events at any other location within the City of Boroondara that Council makes available for purchase. 3. Amendments (a) Council reserves the right to amend, vary or replace these Terms and Conditions from time to time, including for specific events. (b) Council will advise of any variations or amendments to the Terms and Conditions via the Boroondara Arts website. 4. Purchase of Tickets Tickets for performances, events or activities at any Venue are valid only when purchased from Council, or from an entity authorised by Council to sell or distribute tickets. 5. Conditions of Entry (a) The Venue’s conditions of entry form part of these Terms and Conditions and apply to the purchase of your ticket. (b) By attending any event, performance or activity, you agree to comply with the Venue’s Conditions of Entry. 6. Ticket Prices (a) All ticket prices for performances, events or activities are stated in Australian Dollars and include GST (if applicable) and service fee. (b) Other fees may apply depending on method of payment and delivery, including a credit card surcharge and/or postage and handling. (c) If GST is applicable, your ticket is a tax invoice for the transaction. (d) Full priced tickets apply to any person over 16 years of age who does not hold an eligible concession card. (e) Concession priced tickets apply to any person 16 years of age or under and/or the holder of one of the following concession cards: (i) secondary and tertiary Student Cards; (ii) Seniors and Pensioner Card; and (iii) Health Care Card, including Department of Veteran Affairs Health Card. (f) Children under the age of two do not require a ticket, provided they are: (i) seated on the lap of a parent or guardian during the event, performance or activity; and (ii) are supervised by a parent or guardian at all other times when attending or using the Venue. 7. Children Children under the age of 12, including but not limited to school children, must be supervised at all times when attending or using the Venue. 8. Companion Card Scheme (a) Council’s Venues are affiliates of the Companion Card Scheme and operate under the Companion Card Scheme Affiliate Terms and Conditions. (b) A valid Companion Card or valid Companion Card Number must be produced at the time of booking to gain access to the Companion Card program offer. Details of use are contained on the Companion Card website www.companioncard.vic.gov.au. (c) To book tickets through the Companion Card Scheme offer, you must contact the Hawthorn Arts Centre Box Office on 9278 4770. 9. Confirmation and Delivery (a) Council will send tickets to the billing address of the ticket account holder unless otherwise requested. (b) If you wish to collect tickets from the Box Office prior to the event or performance, you must present proof of purchase. Proof of purchase may include the confirmation email, credit card used to purchase tickets and/ or photo identification and valid concession card and companion card (if applicable). (c) Council reserves the right to request proof of concession entitlements or companion card at the time of ticket collection and may withhold tickets if you cannot produce the requisite proof. 10. Refunds (a) To the fullest extent permitted by law, ticket purchases are final and are non-refundable. (b) Provided that you purchased or otherwise received your ticket in accordance with these Terms and Conditions, you will be entitled to a refund or exchange if a performance, event or activity is cancelled, rescheduled or significantly relocated. If a performance, event or activity is cancelled, you will automatically receive a refund. (c) Refunds or exchanges are not available due to a change in personal circumstances or external factors such as, for example, adverse weather. If the event is rescheduled or significantly relocated, the ticket purchaser will be offered a refund. (d) If a refund is applicable it shall include the entire purchase price (excluding any postage or handling fees), which may include the ticket price, GST, and credit card surcharge (if applicable). (e) Refunds will be finalised within 30 days of the cancelled performance, event or activity, or within 30 days of the request for the refund, whichever is the latter. (f) You are not entitled to a refund if your ticket was complimentary or otherwise free. (g) Where the event has not been cancelled, any decision to refund a ticket will be made by the Manager Arts and Culture and the Event Organiser (if applicable). 11. Lost or Forgotten Tickets (a) When a lost or forgotten ticket is reported, the original ticket will be cancelled, and a replacement ticket will be provided. (b) If you report a lost ticket prior to the event, performance or activity, a new ticket can be sent to you via email, collected at the Venue or posted to your address for a fee. Identification must be provided to receive the ticket. (c) If you report a lost or forgotten ticket at the time of the performance, your ticket may only be replaced if you can produce identification that connects you to the original ticket purchase. (d) If you report that a ticket was never received, Council will check the method of distribution and correct contact details as necessary. If the contact details are correct, then the ticket will be treated as a lost ticket. 12. Access and Inclusion Council supports access and inclusion in all Venues. All Venues are wheelchair accessible and service dog friendly. Council has infrared hearing augmentation and priority seats in select venues and premises. If you have access requirements that you would like to discuss, the Council encourages you to contact the Venue staff prior to arrival. 13. Changes to Performances (a) Particulars of any performance, event or activity may change without prior notice. (b) Council will use best endeavours to inform you of any changes to the performance, event or activity prior to commencement. (c) You acknowledge that artists or performers may be added, withdrawn or substituted for specific performances, events or activities. (d) Despite any changes to the artists or performers, Council will use best endeavours to ensure that the original concept of the performance, event or activity is not materially and adversely impacted. 14. Accounts and Privacy (a) Council is committed to fulfilling its obligations under the Privacy and Data Protection Act 2014 (Act). Council is committed to protecting the privacy of its customers and the management of personal information as outlined in its Privacy and Data Protection Policy 2021 (Policy). (b) To purchase a ticket online or over the phone, you must create an account within the Council’s contracted ticketing system provider and provide information including your full name, address and contact number. (c) Your contact details will only be used by Council in relation to the performance, event or activity only, in line with Council’s Policy. Council will not on-sell or release any personal information to a third party without prior approval. (d) You may choose to opt-in to receive future communication on performances, event or activities presented by Council during the purchasing process and/or the third party running the performance, event or activity that you are attending. (e) For externally presented events, your contact information will only be provided to external presenters if you have provided separate permission to do so during the ticket purchasing process. 15. Disputes and Complaints (a) You may lodge a complaint regarding the ticket purchase process, refunds or any other matter to the Manager Arts and Culture. (b) Council will look at the complaint fairly and objectively in line with its Complaints Policy and Customer Service Charter.
